In recent years, Immigration & Customs Enforcement (“ICE”) officials have increased their rate of enforcement and detention of undocumented foreign nationals. Most foreign nationals who do not have criminal convictions and are not security threats to the U.S. are eligible for release on bond. However, many foreign nationals with criminal convictions may be subject to mandatory detention, making him or her ineligible for release on bond.
